By accessing and using Summer on the Yard's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Services Description

Summer on the Yard provides educational tutoring services for children in Pre-K through 6th grade, including:

• One-on-one summer tutoring sessions
• Academic assessment and progress tracking
• Customized learning plans
• Sessions with certified teachers

Use License

Permission is granted to temporarily access the materials on Summer on the Yard's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose
• Attempt to decompile or reverse engineer any software contained on the website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

Tutoring Service Terms

When enrolling your child in our tutoring programs:

• Sessions must be scheduled in advance according to program terms
• Cancellation policies apply as specified in your enrollment agreement
• Parents/guardians are responsible for ensuring child attendance
• Progress reports will be provided as outlined in your program
• Educational materials provided are for personal use only

User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information about your child
• Maintain the security of your account
• Use the services in compliance with all applicable laws
• Not engage in any activity that disrupts or interferes with our services

Payment Terms

Payment terms are as follows:

• Refunds are subject to our refund policy outlined at enrollment
• Late payments may result in service interruption

SMS Terms and Conditions

By opting in to SMS communications from Summer on the Yard:

• You consent to receive automated text messages regarding scheduling, reminders, and promotional content
• Message and data rates may apply
• Message frequency varies
• Reply STOP to cancel, HELP for help
• Carriers are not liable for delayed or undelivered messages

Disclaimer

The materials and services on Summer on the Yard's website are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Service Modifications

Summer on the Yard reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

Limitation of Liability

In no event shall Summer on the Yard, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. Our total liability shall not exceed the amount paid by you for services in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Summer on the Yard and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the services or your violation of these Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
